Allocation Formula

The individual estimated award amounts are an estimate assuming full participation by all members of the settlement class, but excluding any attorneys’ fees and reimbursement of expenses that may be approved by the Court, or any contingency payments from Rubycon.

Settlement proceeds will be distributed on a pro rata basis at the time an allocation is made, based on the total dollar amount of Capacitors that individuals purchased (which are listed in the grid on the Notice you received) relative to the total dollar amount of Capacitors purchased by all members of the settlement class that timely submit valid claims, after deducting Court-awarded fees and expenses as described in the Notice.
