Allocation Formula

The individual estimated award amounts were an estimate assuming full participation by all members of the settlement class, but excluding any attorneys’ fees and reimbursement of expenses that were approved by the Court, or any contingency payments from Rubycon.

Settlement proceeds were distributed on a pro rata basis at the time the allocation was made, based on the total dollar amount of Capacitors that individuals purchased (which are listed in the grid on the Notice you received) relative to the total dollar amount of Capacitors purchased by all members of the settlement class that timely submitted valid claims, after deducting Court-awarded fees and expenses as described in the Notice.
